MY CHAPTER 13 ATTORNEY KEEPS SENDING ME BILLS WHAT CAN I DO?

In the Western District of Michigan Chapter 13 Attorneys can charge by the hour and ask the Court to approve their fees or they can apply for what is known as the “no look” fee.  If the attorney charges the “no look” fee he/she is limited to the court approved fee amount of $3,000-$3,300 depending on the level of experience.  If the Attorney charges by the hour he/she must ask the Court to approve the fee.  Once your case is confirmed the attorney can petition the Court for additional fees for work performed.  This is where your $3000 Chapter 13 can cost you $5,000 – $10,000.  You can do your part by making sure you follow all of the Trustees instructions and make your payments on time.  If you are still getting bills you can object to the request by the Attorney for more fees.  When the Attorney asks for additional fees, you will receive notice and if you believe you are being charged for unnecessary work, or being over charged, you can tell the judge at the hearing and he/she will decide.
