Guardian Ad Litum Fees Not Dischargeable In Bankruptcy

Domestic Support Obligations, such as child support and alimony are not dischargeable in Bankruptcy.  Until recently fees for Court Appointed Guardians ad Litum have been discharged in the Western District of Michigan.  A recent decision from the 6th Cirucuit has held that these fees are not dischargeable.  This is bad news if you are filing for bankruptcy and are saddled with the Guardian Ad Litum Fees by the Divorce Court, its good news if your spouse had the obligation to pay those fees and filed for bankruptcy.  Under those circumstances the Guardian Ad Litum would ask the non-filing spouse to pay the bill.
