CONDOMINIUM FEES MAY BE DISCHARGEABLE IN CHAPTER 13

In an earlier Blog entry, I explained that Condominium fees were no longer dischargeable in a Chapter 7 filing so long as the debtor had an ownership interest in the Condominium.  Recently a decision from the Eastern District of Michigan has suggested that such fees, both pre and post filing, may be dischargeable via a completed Chapter 13 plan, since there is no Chapter 13 exception to discharge.   In re: Ezroy C. Spencer No: 09-74255.   This may be a good option for people saddled with expensive Time Share fees.
